Learn About California Marriage License Costs and Fees

Understanding California Marriage License Basics

A California marriage license is an official government document that allows two people to marry legally in the state. The license serves as a record that a marriage has taken place and is recognized by the state government. Before a couple can have a wedding ceremony, they must first obtain this license from their county clerk's office.

California requires that both people getting married apply for the license together in person at the county clerk's office where they plan to marry, or at any county clerk's office in California. The state does not allow mail-in applications or online submissions for marriage licenses. This in-person requirement exists so that the county clerk can verify the identity of both applicants and confirm that they meet California's marriage requirements.

The marriage license itself is valid for 90 days after it is issued. This means a couple has three months to have their wedding ceremony performed by an authorized officiant. If the 90 days pass without a ceremony taking place, the couple must apply for a new license and pay the fees again. The license can be used anywhere in California, regardless of which county issued it.

California also has a confidential marriage license option, which is a different type of license with limited public access. This option requires both applicants to be at least 18 years old and involves different procedures and sometimes different costs than the standard marriage license. Couples interested in a confidential marriage should ask about this option when visiting the county clerk's office.

Practical Takeaway: Understanding that a marriage license is a three-month window to complete your wedding ceremony helps with planning timelines. Couples should apply for their license with enough time before their planned wedding date to ensure the license is active during the ceremony.

Marriage License Fees by California County

Marriage license fees vary by county in California, which means the cost depends on where you apply for the license rather than being the same statewide. As of recent years, most California counties charge between $35 and $100 for a standard marriage license. Some counties charge fees on the lower end of this range, while others charge fees closer to or at the higher end.

For example, Los Angeles County, which is the most populous county in California, charges $74 for a standard marriage license. San Francisco County charges $110 for a standard marriage license. Smaller or rural counties may charge lower fees, sometimes as low as $35 to $50. These variations exist because California law allows each county to set its own fees within certain legal limits.

The confidential marriage license option typically costs more than a standard marriage license in most counties. Where a standard license might cost $74, a confidential license could cost $110 or more in the same county. The exact difference varies by county. Some counties add $30 to $40 to the standard fee for confidential licenses, while others have different pricing structures.

Additional costs may apply if a couple needs certified copies of their marriage license after the wedding. Once a marriage is performed and registered, couples may want extra official copies for name change purposes, insurance records, or other legal needs. Certified copies typically cost $5 to $15 each per county, and couples can order several copies at once. Some counties allow certified copies to be ordered by mail or in person after the marriage is registered.

County clerk offices sometimes offer payment plans or fee waivers for couples experiencing financial hardship, though these policies vary significantly by county. Couples should contact their specific county clerk's office to ask about fee reduction options if cost is a concern. Having this conversation before applying can clarify what documents a couple will need to provide to request a reduced fee.

Practical Takeaway: Before visiting the county clerk's office, contact that specific county to learn the exact fee amount, payment methods accepted, and any options for fee reductions. This prevents surprises and allows couples to bring the correct payment amount.

Documents Required When Applying for a License

Both applicants must bring valid government-issued identification when applying for a marriage license in California. Acceptable forms of identification include a driver's license, passport, military ID, or state identification card. The identification must be current and show the person's full legal name, date of birth, and a photograph. Expired identification is generally not accepted, so couples should check the expiration dates on their IDs before visiting the county clerk.

Each applicant must also provide proof of age and proof of California residency or legal presence in the United States. For proof of age, a certified birth certificate is commonly used, though other documents may be accepted depending on the county. The birth certificate should show the applicant's full name as it appears on their identification. If a person has changed their name through marriage, divorce, or a court order, they should bring documentation of that name change.

For proof of California residency, a recent utility bill, lease agreement, mortgage statement, or other official document with the applicant's current address typically works. Some counties accept California identification cards or driver's licenses as proof of residency if they show a California address. If an applicant is not a California resident but is a legal permanent resident or has a valid visa, they should bring immigration documentation showing their legal status in the United States.

If either applicant has been previously married, they must provide documentation showing how the previous marriage ended. This means bringing a certified divorce decree, annulment papers, or a death certificate of the previous spouse. California requires this documentation to verify that the applicant is not currently married to someone else. If divorce or annulment papers were issued in another state or country, the couple should bring the certified original documents or certified copies.

Some counties maintain a list of additional documents that may be helpful or required, so calling the county clerk ahead of time can prevent multiple trips to the office. Each couple should verify the specific document requirements with their county before applying. County clerk offices can provide this information over the phone or through their websites.

Practical Takeaway: Make a checklist of required documents for your specific county and gather everything before visiting the clerk's office. Bringing all necessary documents the first time prevents delays and additional trips.

The Application Process and Timeline

The marriage license application process in California involves completing an application form at the county clerk's office. The form asks for personal information from both applicants, including full legal names, dates of birth, places of birth, addresses, and information about any previous marriages. Both applicants must complete the form together in person and sign it in front of the county clerk or an authorized clerk's staff member.

The entire process of applying for a license typically takes 15 to 45 minutes, depending on how busy the county clerk's office is at the time of the visit. Couples are advised to call ahead or check the county clerk's website to learn about wait times or to make an appointment if the county offers that option. Some counties have busy seasons in spring and summer, so couples planning a wedding during popular months may experience longer wait times.

California has a 90-day waiting period that was eliminated in 2020 for standard licenses, meaning couples receive their license the same day they apply. However, some counties may still ask if the couple wants to wait until a later date to pick up the license, in case they want to receive it closer to their wedding date. If a couple requests to pick up the license on a different day, the county clerk will hold it for them until that date.

Once the license is issued, it is valid for 90 days from the date of issue. The couple must have their wedding ceremony performed during this 90-day window by an authorized officiant. Authorized officiants include judges, justices of the peace, religious leaders, and civil ceremony leaders who are registered with the state. After the ceremony, the officiant files the license with the county recorder's office to create an official record of the marriage.

If a couple's license expires before they have their ceremony, they must apply for a new license and pay the fees again. There is no option to extend an expired license. Planning the ceremony date to fall within the 90-day validity period is important for avoiding extra costs and delays.

Practical Takeaway: Schedule the county clerk visit a few months before the intended wedding date to ensure the 90-day validity window covers the ceremony. Allow extra time if the wedding is planned during busy seasons.

Payment Methods and Receipt Documentation

California county clerk offices accept various forms of payment for marriage license fees. Most offices accept cash, checks, debit cards, and credit cards. Some counties have moved toward accepting digital payment methods, though this varies by location. Before visiting the county clerk, couples should confirm what payment methods that specific county accepts.
