Learn About EZ-Pass Violations and Unpaid Tolls

Understanding EZ-Pass Violations and How They Happen

EZ-Pass is an electronic toll collection system used across the northeastern United States and some midwestern states. The system works by reading a small transponder mounted on your vehicle's windshield as you pass through toll plazas. Instead of stopping to pay cash, the toll amount is automatically deducted from your prepaid account. While the system is convenient for millions of drivers, violations and unpaid tolls occur more frequently than many people realize.

An EZ-Pass violation typically occurs when a toll transaction cannot be processed properly. This might happen because your account has insufficient funds, your transponder is malfunctioning, or your account information is outdated. According to the New Jersey Turnpike Authority, thousands of toll violations are recorded each month across their system alone. A violation doesn't automatically mean you're breaking the law intentionally—it often indicates a technical issue or administrative error that needs correction.

The consequences of violations vary depending on the state and toll authority involved. Most agencies distinguish between simple toll non-payment and more serious violations. In New Jersey, for example, unpaid tolls can result in surcharges added to your account, vehicle registration holds, or civil penalties. In New York, the situation may be handled through the MTA (Metropolitan Transportation Authority) with different penalty structures. Pennsylvania, Delaware, and other states using EZ-Pass have their own specific violation procedures.

Understanding how violations happen is the first step toward preventing them. Many people don't realize that a malfunctioning transponder, an expired account registration, or a name change that wasn't updated with the toll authority can all trigger violations. Some violations occur simply because the toll booth camera couldn't read a license plate clearly, making it impossible to identify and bill the vehicle owner.

Practical Takeaway: Monitor your EZ-Pass account regularly through your state's toll authority website. Check your account balance monthly, ensure your registration information is current, and verify that your transponder is securely mounted on your windshield.

The Different Types of EZ-Pass Violations

Not all EZ-Pass violations are created equal. Understanding the different categories helps you identify what type of violation you might be dealing with and what actions may be necessary. The primary categories include insufficient funds violations, toll evasion charges, transponder issues, and registration-related violations.

An insufficient funds violation is the most common type. This occurs when you pass through a toll plaza but your EZ-Pass account doesn't have enough money to cover the toll. When this happens, the toll authority typically issues a notice requesting payment of the unpaid toll amount plus an administrative fee. In many states, you have 30 days to pay before additional penalties apply. For example, if a toll costs $2.75 but your account only has $0.50, that $2.25 shortfall becomes a violation. Administrative fees can range from $5 to $15 depending on your state.

Toll evasion is a more serious category that involves deliberately avoiding toll payment or using fraudulent methods. This might include using a transponder assigned to another vehicle, covering your license plate, or removing a transponder intentionally. Toll evasion is treated as a violation of law in most states and can result in civil penalties, criminal charges, or both. Some states have prosecuted toll evasion cases involving amounts as small as $50, while others focus on larger patterns of evasion. The severity depends on the frequency and apparent intent.

Transponder-related violations occur when your EZ-Pass device isn't functioning properly or hasn't been updated. An expired transponder, a transponder from a different state that isn't recognized, or a device that's been damaged can all cause violations. Some older transponders become incompatible with upgraded toll plaza technology. When a toll plaza can't read your transponder, cameras photograph your license plate and a toll violation notice is sent to the vehicle's registered owner.

Registration violations happen when your vehicle information is outdated or incorrect with the toll authority. If you bought a used car with an EZ-Pass transponder registered to the previous owner, for example, tolls might be billed to the wrong person. Similarly, if you changed your name or address and didn't update your toll account, notices might not reach you, and violations can accumulate without your knowledge.

Practical Takeaway: Identify which type of violation you're dealing with by reviewing the notice you received. Check whether the violation involves a specific toll transaction date, your account balance, or your vehicle registration information. This information guides your response.

How Unpaid Tolls Create a Cascade of Penalties

When a toll goes unpaid, the financial consequences extend beyond the original toll amount. Most toll authorities have a structured penalty system that increases costs the longer a violation remains unresolved. Understanding this escalation helps explain why a $3 toll can eventually become a $50+ problem.

The typical penalty progression works like this: First, a violation notice is issued, usually within 30 to 45 days of the toll transaction. This notice includes the original toll amount plus an administrative fee, typically ranging from $5 to $15. At this stage, you're often given 30 days to pay without additional penalties. If payment isn't received, a second notice is issued with an increased penalty fee, sometimes called a "late fee" or "collection fee," which might add another $10 to $25.

If violations remain unpaid, many states place a hold on vehicle registration renewal. In New Jersey, the Turnpike Authority reports that vehicle registration holds are one of the most common enforcement tools. You cannot renew your registration until outstanding tolls are paid. This creates a practical problem: you can be stopped for driving an unregistered vehicle, which carries its own penalties. In New York, the MTA can pursue toll collection through the Department of Motor Vehicles, similarly blocking registration renewals.

Some states take additional enforcement action. Pennsylvania can report unpaid tolls to credit reporting agencies after a certain period of non-payment. Multiple unpaid tolls can affect your credit score, making it harder to obtain loans or credit cards. Other states may use collection agencies, which add their own fees and can continue pursuing payment for years. A study by the American Trucking Association found that unpaid tolls often result in total costs that are 200-300% of the original toll amount when all penalties and collection fees are included.

In rare cases involving significant unpaid tolls or patterns of apparent evasion, criminal charges may be pursued. Most states require $1,000 or more in unpaid tolls before considering criminal prosecution, though this varies by jurisdiction. Civil lawsuits by toll authorities can result in court judgments that affect your ability to obtain credit or professional licenses.

Practical Takeaway: Pay violation notices promptly when they arrive. Delaying payment only increases the total amount owed. Most toll authorities offer payment plans for large unpaid toll amounts, so contact them directly if you cannot pay in full immediately.

Responding to an EZ-Pass Violation Notice

Receiving a violation notice can be stressful, but the notice itself provides important information and options. The notice typically includes the violation date, the toll plaza location, the amount owed, the deadline for payment, and instructions for disputing the violation if you believe it's incorrect.

Your first step should be to verify the accuracy of the violation. Check whether you were actually traveling on that toll road on the date listed. Review your transaction history in your EZ-Pass account online. Most states allow you to access your full transaction history through a website portal. Look for the specific toll transaction and confirm whether your account was properly charged or whether this was indeed a violation.

If you believe the violation is incorrect, most toll authorities allow you to file a dispute or request a hearing within a specific timeframe—often 30 days from the notice date. This might apply if: you weren't driving the vehicle on that date, you have proof your account was properly charged, you have evidence that the toll plaza was malfunctioning, or you're disputing the vehicle identification. To file a dispute, you'll typically need to submit a written request explaining your position and any supporting documentation, such as receipts, transaction histories, or witness statements. Some states now allow disputes to be filed online through their toll authority websites.

If you cannot dispute the violation successfully, or if you agree the toll should have been paid, you'll need to pay the amount due. Most toll authorities accept payment through their websites using credit cards, bank transfers, or prepaid accounts. Some also accept payment by phone or mail, though online payment is usually fastest.
