Learn About Texas Open Carry Laws and Requirements

Understanding Texas Open Carry Laws and Historical Context

Texas has a unique history with firearms and personal protection that shapes its current open carry laws. Unlike many states that strictly limited visible gun carrying for decades, Texas has gradually moved toward more permissive open carry regulations, particularly in recent years. Understanding this history helps clarify why Texas's current laws differ from other states and what they mean for residents.

Prior to 2015, Texas prohibited most open carry of handguns in public spaces. Residents could carry rifles and shotguns openly, but handguns had to be concealed if carried at all. This created an interesting legal distinction where long guns were more visible than pistols. In 2015, the Texas Legislature passed House Bill 910, which changed this landscape significantly. This law took effect on January 1, 2016, and allowed licensed handgun carriers to openly display their weapons.

The shift reflected broader conversations happening across the state about Second Amendment rights and personal freedom. Texas joined numerous other states in recognizing open carry as a legitimate form of self-defense and expression. The law applied specifically to individuals with a License to Carry (LTC), which is Texas's official permit system for gun ownership.

Currently, Texas distinguishes between different categories of firearm carry. Handgun open carry requires a License to Carry. Rifle and shotgun carry generally does not require a license in many circumstances, though certain restrictions apply in specific locations. Understanding these distinctions matters because the rules differ based on the type of weapon and the specific location where carrying occurs.

Practical Takeaway: Texas open carry laws changed significantly in 2015 when handgun open carry became legal for licensed individuals. Knowing the state's history with these laws helps explain current regulations and why Texas treats handguns and long guns differently in some situations.

License to Carry Requirements and How to Understand Them

To openly carry a handgun in Texas, a person must obtain a License to Carry from the state. This license is not optional for handgun open carry—it is a legal requirement. Understanding what the License to Carry involves, what it costs, and how long the process takes provides important information for anyone considering this option.

The License to Carry in Texas is issued by individual county sheriffs, though the state sets statewide standards. The license costs $40 for a five-year permit as of current rates, though this fee may change over time. Some counties offer reduced fees for certain populations, such as seniors or disabled individuals. The application process involves submitting paperwork to your county sheriff's office along with the required fee.

To obtain a License to Carry, Texas law requires applicants to be at least 18 years old (or 21 for handguns if moving forward with handgun carry specifically). Applicants must be legal residents of the United States and cannot have certain criminal convictions or restraining orders. The law excludes people with felony convictions, certain misdemeanor convictions related to violence, and individuals subject to protective orders from carrying guns.

The application includes a background check conducted by the county sheriff. This check examines criminal history, mental health records that might indicate danger to self or others, and other factors that Texas law specifies. Once approved, the license is valid for five years before renewal is needed. During those five years, the licensee can carry a handgun openly in most public places throughout Texas.

The actual timeline for receiving a license varies by county. Some counties process applications within two to three weeks, while others may take several months. It's worth contacting your specific county sheriff's office for their processing timeframe. Many county sheriff offices now accept applications online or by mail, though some still require in-person submission.

Practical Takeaway: A License to Carry costs $40 for five years and requires background checks and age verification. The application process happens through your county sheriff's office, and processing times vary significantly by location, so contact your local sheriff to understand the specific timeline and procedures in your area.

Where Open Carry Is Permitted and Where It Is Prohibited

Texas open carry law does not mean you can carry a handgun anywhere at any time. Specific locations remain off-limits for open carry, even with a valid License to Carry. Understanding where these restrictions exist protects licensed carriers from unintentional violations and helps them make informed decisions about where to carry.

Federal properties prohibit open carry under federal law. This includes federal courthouses, federal office buildings, military installations, and certain federal parks. These restrictions apply regardless of state law because federal law supersedes state law in these spaces. Property owners and private businesses also retain the right to prohibit firearms on their premises, even if they are licensed. Many businesses post signs at entrances indicating their policies on weapons.

Schools and school-sponsored events have firearms restrictions. Public schools, private schools, and school buses all prohibit guns on their premises or property, with limited exceptions for security personnel. Colleges and universities also maintain their own policies, with most public universities prohibiting open carry on campus, though this remains a developing area of Texas law.

The following locations have specific legal restrictions on firearms carry:

• Correctional facilities and detention centers
• Mental health facilities and psychiatric hospitals
• Secured areas of airports (though firearms can be carried in certain terminal areas)
• Courthouses and court buildings
• Certain government buildings designated by official notice
• Private property where the owner has prohibited firearms

Businesses, restaurants, and private property owners can prohibit open carry by posting signs or by verbal notification. Texas Property Code allows property owners to exclude anyone from their property, including those carrying firearms. Many private establishments choose to remain firearm-neutral and do not post restrictions, meaning licensed carriers may carry there, though they should always respect posted policies.

Certain events and venues present special considerations. Professional sporting events often have weapons policies. Concert venues, movie theaters, and similar entertainment venues frequently prohibit firearms, though this depends on individual business policy rather than state law. It's always wise to call ahead and confirm a business's policy before arriving with an openly carried firearm.

Practical Takeaway: Federal properties, schools, courthouses, and secured airport areas prohibit open carry under law. Private businesses can also prohibit firearms regardless of state law. Always check for posted signs and call ahead when uncertain about a specific location's policy.

Open Carry Without a License: Long Guns and Special Circumstances

While handgun open carry requires a License to Carry, Texas law treats rifles and shotguns differently in many situations. Understanding what can be carried without a license helps clarify the full picture of Texas open carry laws and may reflect options available to those without a License to Carry.

A person can openly carry a rifle or shotgun in Texas without a License to Carry in many public spaces. This right comes from both state law and constitutional considerations. However, this right is not unlimited. The person must be at least 18 years old and cannot carry long guns in certain prohibited locations, such as schools, courthouses, and other restricted areas that apply to all firearms.

Long gun carry without a license comes with important caveats. First, local jurisdictions may have additional restrictions. Some cities and counties have ordinances that limit long gun carry in certain areas or circumstances. Second, the context matters significantly. Carrying a rifle while hunting or at a shooting range has different legal standing than carrying one down a city street. Law enforcement may approach and question someone carrying a long gun openly, particularly in urban areas where this is uncommon.

Constitutional carry, sometimes called permitless carry, has been discussed in Texas legislature but has not been enacted into law as of the current time. This means that Texas still requires a License to Carry for handguns, even though long guns have more permissive carry rules. It's important to stay informed about any legislative changes, as these laws can evolve.

Practical situations where long gun carry is common include hunting, traveling to and from hunting areas, visiting shooting ranges, and participating in militia-related activities or sporting events. In these contexts, openly carrying a rifle or shotgun raises fewer legal questions than carrying one while shopping or walking through downtown areas.

The distinction between handguns and long guns in Texas law reflects different historical perspectives on these weapons. Long guns have traditionally been associated with rural activities like hunting and ranching. Handguns are more associated with personal protection in urban settings. This historical distinction continues to shape how Texas law treats each category differently.
