Understanding Felony Pardons and Your Options

What Felony Pardons Are and How They Work

A felony pardon is a formal act of forgiveness issued by a government official—usually a governor or president—that removes a conviction from a person's criminal record. When someone receives a pardon, it means the government is acknowledging that the conviction should no longer define their legal status or public reputation. The pardon does not erase the crime itself; rather, it declares that the person should not face ongoing punishment or legal consequences because of that conviction.

The power to issue pardons comes directly from state constitutions and the U.S. Constitution. Forty-nine states have some form of pardon authority, typically held by the governor. At the federal level, only the President can pardon federal crimes. Each state has its own rules about when pardons can be granted, how many times someone can request one, and what crimes are pardoned most often.

Historically, pardons were more common. According to data from the Pew Charitable Trusts, between 1974 and 2022, U.S. presidents issued roughly 15,000 pardons. However, the number varies widely by administration. Some governors and presidents issue many pardons; others issue very few. For example, during his presidency, Bill Clinton issued 140 pardons in his final days in office, while George W. Bush issued 140 pardons across his entire two terms.

Pardons can address different outcomes depending on the state or federal system. A full pardon typically restores certain rights and allows the person to say they were pardoned when asked about their conviction on most applications. A conditional pardon may come with restrictions or requirements. Some jurisdictions also offer "pardons for innocence," which are specifically for people later proven to be innocent of their crimes.

Practical Takeaway: Understanding that a pardon is a formal declaration of forgiveness—not an erasure of history—helps you recognize what a pardon can and cannot do for your record and your future.

The Difference Between Pardons, Expungements, and Other Record Relief Options

Many people confuse pardons with other forms of record relief because they all relate to criminal records, but they work in different ways. It is important to understand these distinctions because the option that works for you depends on your situation, your state, and your criminal history.

An expungement is a legal process that removes or hides a conviction from public records. When a record is expunged, it is typically destroyed or sealed, meaning most employers, landlords, and other members of the public cannot see it. Some states allow expungements for certain misdemeanors, lower-level felonies, or arrests that did not lead to conviction. However, many states do not allow expungement of felony convictions at all. Expungement is usually handled through the court system where you were convicted, not through a pardon authority.

A record suspension (sometimes called a conviction suspension) is another option in some states. This pauses certain consequences of a conviction without formally removing it. For example, a suspension might restore voting rights or allow you to say "no" to a question about criminal history on a job application, even though the record still exists in court files.

A certificate of rehabilitation is available in some states, including California. It is a court-ordered declaration that you have been rehabilitated since your conviction. While it does not erase the conviction, it shows employers and licensing boards that you have changed. Some states consider certificates of rehabilitation when deciding whether to issue a pardon later.

Restoration of rights is a blanket term for processes that return specific legal rights taken away by a felony conviction, such as voting rights, gun ownership rights, or the right to hold certain professional licenses. Some states automatically restore rights after a sentence is completed; others require a separate legal process.

The key difference: a pardon comes from the executive branch (governor or president) and represents forgiveness; expungement and record suspension come through the court system and hide or pause consequences; restoration of rights focuses on specific legal abilities rather than the conviction itself.

Practical Takeaway: Before seeking any form of record relief, research what is actually available in your state for your type of conviction, as options vary widely and the wrong approach may waste time and resources.

Who Can Receive a Pardon and General Timing Requirements

Pardon rules differ from state to state, and there is no single standard for who can receive one. However, certain patterns are common across most jurisdictions.

Most states require that a person have completed their sentence before they are considered for a pardon. This typically means finishing prison time, probation, and paying any fines or restitution owed. A few states allow pardons while someone is still incarcerated, but this is rare. The intent behind this requirement is to show that the person has fully complied with their sentence.

Waiting periods are another common requirement. Many states specify that a person must wait a certain number of years after their conviction before they can seek a pardon. These waiting periods range from one year (in some states) to ten years or more (in others). For example, Texas requires a minimum of five years after sentence completion; some federal crimes require much longer waiting periods. The waiting period reflects the idea that time should pass to demonstrate whether someone is truly reformed.

Some crimes are exempt from pardon consideration in certain states. These often include murder, rape, child abuse, and other serious violent crimes. A few states do not pardon crimes of violence at all. Other states treat sexual offenses differently and may have stricter pardon standards for crimes involving children. Federal law prevents pardons for impeachment convictions.

Citizenship status can matter. Some states pardon only citizens; others pardon non-citizens as well. If you are not a U.S. citizen, a pardon might affect immigration status in ways that are difficult to predict, so legal advice from an immigration attorney would be important before pursuing one.

Prior pardon history also plays a role. Most states limit how many pardons one person can receive. Some allow only one pardon; others allow two or three; still others have no strict limit. If you have already received a pardon, you may not be able to receive another.

Some states pardon only people of good moral character who show genuine remorse and evidence of rehabilitation. They look at what you have done since your conviction: employment history, community involvement, letters from employers or community members, and whether you have had any legal problems since the conviction.

Practical Takeaway: Check your state's specific pardon rules regarding waiting periods, completed sentences, restricted crimes, and any other requirements before you invest time in gathering materials or researching your options further.

How Pardon Applications and Processes Work in Practice

The practical steps for seeking a pardon vary depending on whether you are pursuing a state or federal pardon, and which state you are in. However, the general process follows similar stages.

First, you must verify that you meet your state's or the federal government's basic requirements. This means checking waiting periods, sentence completion, and any restrictions on your crime type. Most pardon authorities publish their rules and requirements online, usually on the governor's website or the state board of pardons website.

Second, you gather documentation. This typically includes your original conviction documents (sentencing paperwork, judgment and commitment order), proof that you have completed your sentence (probation completion certificates, proof of fine payment), and character references. Character references are letters from employers, community members, clergy, teachers, or others who know you and can speak to your character and rehabilitation. These should come from people outside your immediate family and should describe specific evidence of your changed behavior or contributions to your community.

Third, you complete the formal application or petition. The format depends on your jurisdiction. Some states use a written application form; others require a formal petition submitted to a court; still others use a combination. Federal pardon petitions go through the Office of the Pardon Attorney at the U.S. Department of Justice. The application usually asks for your personal history, details of your crime and conviction, your life since conviction, and reasons why you believe you should receive a pardon.

Fourth, your application goes through review. This process can take months or even years. Some states have a pardon board that reviews applications and makes recommendations to the governor. Other states have the governor's office review applications directly. Federal petitions go through the Office of the Pardon Attorney, which investigates your case and may interview you or people you know. During this time, your conviction record
